Compensation for permanent incapacity for work (private sector)

If you are in permanent incapacity of work as a result of an occupational disease, you are entitled to benefits for permanent incapacity for work. 

Fedris allocates you a degree (percentage) of incapacity for work based on your physical disability and its impact on your capability to work. Your annual benefits are equivalent to that percentage of your basic salary. Please note that the basic salary used to calculate your benefits may never exceed the maximum basic salary.

If your degree of incapacity for work is 16% or more, your annual benefits will also be indexed.

If your degree of incapacity for work is less than 5%, your benefits for incapacity for work will be reduced by half.

If your degree of incapacity for work is between 5% and 9%, your benefits for incapacity for work will be reduced by a quarter.

You are paid the benefits for permanent incapacity on a monthly basis, usually at the end of the month, from the date on which your incapacity for work began, but never more than 120 days before the date on which you applied to Fedris. These benefits are equivalent to your annual benefits divided by 12 months. In some cases (when the net amount is less than € 128,27 (last modification 01/11/2023)), you are paid on a quarterly basis.

Fedris may also pay you outstanding arrears if you were granted the benefits before the date on which you applied. These outstanding arrears are often reimbursed to another institution (e. g. your health insurance) when the latter pays you advances pending Fedris' decision.
