Declaration
As an employer, you must declare every accident that occurred to one of your employees, at work or on the way to or from work, to your insurance company. You can declare the accident yourself or ask your social secretariat to do it for you. Your insurance company will decide whether the accident is an occupational accident or not.
If you are not insured against occupational accidents, you must declare every accident at work or on the way to or from work to Fedris. If the accident is recognised as an occupational accident, Fedris will indemnify the victim as an insurance company would do and then reclaim the expenses from you, in addition to the automatic affiliation contribution. You may also face criminal prosecution.
When do you declare the accident?
8 days from the day you have been informed about the accident.
How do you declare the accident?
- You can use the online service (in French) on the social security portal. You need a specific access (in French). You will receive a copy of your declaration by e-mail. Your declaration gets a unique number. Do not forget that a simplified declaration can be enough if the victim is already back at work after less than 4 days of incapacity (from the day after the date of the accident) when the accident is declared.
- You can fill in the paper version of the declaration form (in Dutch/French) and send it to your insurance company.
- You can use the software provided by your insurance company and send your declaration directly online. For more information, contact your insurance company.
