Declaration

As an employer, you must declare every accident that occurred to one of your employees, at work or on the way to or from work, to your insurance company. You can declare the accident yourself or ask your social secretariat to do it for you. Your insurance company will decide whether the accident is an occupational accident or not.

If you are not insured against occupational accidents, you must declare every accident at work or on the way to or from work to Fedris. If the accident is recognised as an occupational accident, Fedris will indemnify the victim as an insurance company would do and then reclaim the expenses from you, in addition to the automatic affiliation contribution. You may also face criminal prosecution.

When do you declare the accident?

You have to declare the accident to your insurance company within 8 days from the date of the accident. Even if this deadline expires, you have to declare the accident as quickly as possible and in each case before the 3 year period of limitation after the date of the accident has passed.

If you do not declare the accident or if you declare it too late, you may face criminal prosecution.

The 8 day deadline does not apply for an accident that meets the criteria of a minor accidents. For minor accidents, you only have to fill in your first-aid record book as soon as you have been informed of the accident. You need to mention the name of the victim and first aider, place, date and time of the accident, description and circumstances of the accident, date and time of the intervention, type of injury, type of intervention, name(s) of the witness(es). However, if the victim's health deteriorates, you will have to declare the accident to your insurance company within
8 days from the day you have been informed about the accident.

How do you declare the accident?

You have 3 options to declare an accident:

  1. You can use the online service (in French) on the social security portal. You need a specific access (in French). You will receive a copy of your declaration by e-mail. Your declaration gets a unique number. Do not forget that a simplified declaration can be enough if the victim is already back at work after less than 4 days of incapacity (from the day after the date of the accident) when the accident is declared.
  2. You can fill in the paper version of the declaration form (in Dutch/French) and send it to your insurance company.
  3. You can use the software provided by your insurance company and send your declaration directly online. For more information, contact your insurance company.
As soon as you get it, do not forget to send the medical certificate that was issued at the time of the accident to your insurance company.

You must also declare all serious accidents  to the labour inspection (in French).

A minor accident must only be registered in the first-aid record book, except if the victim's health later deteriorates because of that accident.
